Always get it in writing.

I've been in the same apartment for 4 years. My first least was from 8/06-7/07, so each lease after that was the same months for the following year. However this last year I never resigned the lease. As with most leases I assumed that this put me on a month to month plan. I wanted it this way so that I could move out in May of '10 and not have to pay rent for an empty apartment in June and July. I went to the office in January to confirm that this is how it would work. I was told that all I had to do was put in a 60 day notice and I could get out whenever I wanted. I was also told that if I left halfway through May I could get it prorated and only pay half of May's rent.

I just went over to the office to put in my 60 day notice, the same woman pulled out my lease and told me that I was responsible to pay the rent through July. I reminded her that I never resigned and that she herself told me that I could put in a 60 day notice whenever I wanted to. She started on this, "well technically yea....." stuff. She said that she would talk to the property manager and that he would most likely let me leave, but if not I would be responsible through 7/10.

I guess if they tell me no I'll just leave when I want to, quit paying rent, and tell them that if they have a problem I'll see them in court.
